TERMS & CONDITIONS

By booking with us you enter into a contract with Gecko Events whereby these terms and conditions apply to culinary events, special events, event venues and catering services offered by us.  By making a booking, you agree to be bound by these terms and conditions in which we guarantee to provide the services as mutually agreed in a written contract.

Bookings, Confirmation and Refunds

1. You can make a booking request through our website by filling out the online form on our Contact Page with your details and preferences for the event venue, date, time, number of guests, catering menu and any other requirements.
2. We will review your booking request and send you a confirmation email within 48 hours if we can accommodate your request. The confirmation email will include the details of your booking, the total price, the deposit amount and the payment methods.
3. Your booking will be confirmed and added to our calendar when you pay the deposit amount within 7 days of receiving the confirmation email. If you fail to pay the deposit within this period, we will assume you do not require the venue or our services.
4. Due to the nature of our business, our venues and events are booked months in advance. So, to offset a loss of income as we will not be able to resell the venue or event booking we will need to retain your deposit if you cancel your booking at any time. It is advisable to take out relevant insurance to cover such a circumstance.
5. The deposit amount is 50% of the total price and is non-refundable in case of cancellation by you. The remaining balance is due 45 days before the event date. If you fail to pay the balance within this period, we reserve the right to cancel your booking and retain the deposit unless a prior payment arrangement has been agreed upon in writing by both parties.
6. Changes to your booking may be made up to 21 days before the event date, subject to availability and our approval. Any changes may incur additional charges, which will be communicated to you before confirming the changes. You cannot make any changes to your booking within 21 days of the event date.
7. All cancellations and changes are to be in writing.
8. If you cancel your booking less than 45 days before the event date, You will be liable for the full amount of the event booking.
9. We reserve the right to cancel your booking at any time for any reason, such as force majeure, unforeseen circumstances, breach of these terms and conditions or non-payment. In this case, we will notify you as soon as possible and refund you any amount that you have paid within 14 days of notifying you.

Event Venue and Catering Services
1. We will provide you with the event venue and catering services as agreed in your booking confirmation, subject to these terms and conditions and any applicable laws and regulations.
2. You are responsible for ensuring that all your guests comply with these terms and conditions and any applicable laws and regulations while using our event venue and catering services. You are liable for any damage or loss caused by you or your guests to our property or equipment during or after the event.  Damage or losses incurred will be deducted from your breakage deposit. Should the damage or loss be greater than your breakage deposit, you will be required to pay for such on presentation of an invoice detailing all damages or losses.
3. You are responsible for obtaining any necessary permits or licenses for your event, such as music or entertainment licenses. The venue holds the liquor license and so all proceeds from the sale of alcohol or refreshments are for Gecko Events account.  No alcohol or refreshments may be brought onto the Durban Jewish Club site which includes any area in the car park, unless otherwise agreed in writing before the event.
4. We reserve the right to refuse entry or service to anyone who is intoxicated, disorderly, abusive or otherwise inappropriate. We also reserve the right to terminate your event at any time if we deem it necessary for safety, security or legal reasons.
5. We will make every effort to ensure that our event venue and catering services are of high quality and meet your expectations. However, we are not liable for any failure or delay in providing our services due to causes beyond our reasonable control, such as fire, flood, storm, power outage, equipment malfunction, supplier shortage or staff illness. In such cases, we will try to remedy the situation as soon as possible or offer you an alternative solution.

Disclaimer and Limitation of Liability
1. We provide our event venue and catering services on an “as is” and “as available” basis, without any warranties or guarantees of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties and guarantees regarding our services, including but not limited to warranties of merchantability, fitness for a particular purpose, quality, accuracy, completeness or reliability.
2. To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, consequential, special or exemplary damages or losses arising from or in connection with your booking or use of our event venue and catering services, including but not limited to damages or losses for loss of profit, revenue, data, goodwill, reputation, business interruption, personal injury, property damage or any other loss or damage of any kind, whether based on contract, tort, negligence, strict liability or otherwise, even if we have been advised of the possibility of such damages or losses.
3. Our total liability to you for any claim arising from or in connection with your booking or use of our event venue and catering services is limited to the amount that you have paid to us for the services in question.

Indemnity
1. You agree to indemnify, defend and hold us harmless from and against any and all claims, demands, liabilities, damages, losses, costs and expenses (including legal fees) arising from or in connection with your booking or use of our event venue and catering services, including but not limited to claims arising from or in connection with your breach of these terms and conditions, your violation of any applicable laws or regulations, your infringement of any third party rights or your negligence or misconduct.

Personal Information
1. Except as set out in this Privacy Policy Gecko Events does not disclose or sell your personal or company information to any third parties.

General
1. These terms and conditions constitute the entire agreement between you and us regarding your booking and use of our event venue and catering services. They supersede any prior agreements, understandings or representations, whether oral or written.
2. These terms and conditions are governed by and construed in accordance with the laws of South Africa. Any disputes arising from or in connection with these terms and conditions will be subject to the exclusive jurisdiction of the courts of South Africa.
3. If any provision of these terms and conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision will be severed from the rest of these terms and conditions and the remaining provisions will continue in full force and effect.
4. We may assign or transfer our rights and obligations under these terms and conditions to any third party without your consent. You may not assign or transfer your rights and obligations under these terms and conditions to any third party without our prior written consent.
5. We may amend or update these terms and conditions from time to time by posting the revised version on our website. The revised version will apply to any bookings made after the date of posting. You are advised to check our website regularly for any changes to these terms and conditions.

1. The information on this site may contain errors or omissions and may not suit your needs. Gecko Events does not guarantee the accuracy or completeness of the information and disclaims any liability for any loss, damage, cost or expense (direct or indirect) that you may suffer because of any error, omission or misrepresentation on this site. This disclaimer is subject to any applicable laws that cannot be excluded.
